Senate Confirms New NLRB Board Member

Last week, the U.S. Senate confirmed James Macy, a Republican, to fill one of two current vacancies on the National Labor Relations Board (NLRB or Board). President Trump nominated Macy in April to join the Board. Macy is a management-side labor and employment lawyer. His appointment to the Board creates a three-person Republican majority with current Board Members Scott Mayer and James Murphy. This is good news for employers who have been waiting for the Board to roll back harmful changes in the law during President Biden’s term.  

The Senate also confirmed another term for current Democratic Board Member David Prouty whose term was scheduled to expire on August 27. Thus, the Board is now short only one Board Member. Whether President Trump will seek to fill this seat remains to be seen.
