NLRB Update
On April 13, 2026, President Trump nominated Republican James Macy to join the National Labor Relations Board (NLRB or Board). He also nominated current Democratic Board Member David Prouty for another term. If approved by the U.S. Senate, these nominations would result in a 4-person Board for the first time since President Trump took office. More importantly, Macy’s confirmation will provide the majority needed to roll back decisions issued by the Biden Board.
Macy is a management-side labor and employment lawyer who joined the U.S. Department of Labor last year. His confirmation would form a three-person Republican majority with current Board Members Scott Mayer and James Murphy, nominated by President Trump last year. These new Board Members have made it clear they will stick to NLRB tradition and refrain from changing precedential rulings until a three-member majority exists. Macy’s confirmation will be good news for employers who have been waiting for the NLRB to “undo” the progressive decisions issued during President Biden’s term.
If both nominations are approved, the Board will only be missing one member. Whether and when President Trump will seek to fill that seat remains to be seen.
