EEOC Updates COVID-19 Guidance

Yesterday, the U.S. Equal Employment Opportunity Commission (EEOC) updated its COVID-19 technical assistance entitled, “What You Should Know About COVID-19 and the ADA, Rehabilitation Act, and Other EEO Laws.”

The revised document adds 18 questions and answers that have been adapted from two other EEOC technical assistance resources; the new Q&As are identified with the date 9/8/20 in parentheses. The EEOC has also updated two existing Q&As, A.6., to more fully explain the EEOC’s position about employers administering COVID-19 tests before permitting employees to enter the workplace, and D.8., to clarify its position on employers’ authority to invite employees not currently in the workplace to request disability accommodation in advance of an expected return.
