DOL Publishes Guidance On PUMP Act & New FLSA Poster

On May 17, the U.S. Department of Labor (DOL) published a Field Assistance Bulletin addressing the Providing Urgent Maternal Protections for Nursing Mothers Act (the PUMP Act) passed by Congress earlier this year. This Bulletin highlights a new updated FLSA poster that includes information on the PUMP Act. Employers should update their FLSA posting in the workplace with this new poster, dated April 2023.  

Although a Field Assistance Bulletin is written for DOL staff members who investigate charges against employers, it can be a useful tool for an employer because it provides specific information about how the DOL interprets and plans to enforce the law. The Field Assistance Bulletin on the PUMP Act provides extensive detail on this new law as well as examples to demonstrate how the law should be applied.

We encourage all employers to review the Field Assistance Bulletin and save it as a resource for future use. This bulletin only addresses the federal PUMP Act and does not address Nevada law which has provided pumping break benefits to nursing mothers since 2017.
