DOL Issues New Independent Contractor Rule, But …

The U.S. Department of Labor has released a new standard for determining whether a worker is an independent contractor under the Fair Labor Standards Act (FLSA). The new employer-friendly rule should take effect March 8, 2021. However, President-Elect Biden has indicated that this rule will be “frozen” on Inauguration Day. Because the new standard may be up in the air for some time, Nevada employers cannot yet rely on it and should simply continue to monitor this matter.
