Alert – OSHA’s Vaccination ETS For Large Employers To Be Published Tomorrow

The federal Occupational Safety and Health Administration (OSHA)’s Emergency Temporary Standard (ETS) to implement President Biden’s September order requiring employers with 100 or more employees to adopt a vaccination program is scheduled to be published in the Federal Register tomorrow, November 5. Nevada’s OSHA can adopt the federal ETS in its entirety or adopt an ETS that is at least as effective within 30 days. We expect NV OSHA will adopt the federal ETS, rendering it immediately effective in Nevada.

We are preparing a detailed summary of the ETS for you, but, in the meantime, a variety of information is available on OSHA’s website. Employers have 30 days from the ETS’ publication to comply with most of the ETS’s requirements (early December), and 60 days to comply with the testing requirements (early January).
