NLRB Suspends Request For Briefs On Construction Industry Question

We previously notified you that the National Labor Relations Board (NLRB or Board) invited the filing of briefs on two issues related to the construction industry. On October 15, 2018, the Board suspended this request for one case, Loshaw Thermal Technology, which presented the issue of whether Section 9(a) bargaining relationships in the construction industry may be established by contract language alone. Because the charging party in that case, the union, withdrew its charge, the Board has notified the public that “no additional briefs should be filed in this case until further notice.”
