NLRB Releases Strategic Plan

The National Labor Relations Board has published its Strategic Plan for fiscal years 2019 through 2022. The Board intends to increase the timeliness of case processing, including reducing processing time for unfair labor practice charges and ensuring that representation cases are resolved within 100 days of an election petition. The Board also intends to focus on recruiting, developing and retaining “a highly motivated, productive, talented, and diverse workforce,” and will seek to improve its use of technology.
In support of the Strategic Plan, the Board’s General Counsel has issued Memorandum GC 19-02, Reducing Case Processing Time. This memorandum immediately eliminates the Board’s “Impact Analysis” program that separated unfair labor practice cases into three categories and assigned time targets to each category. Instead of nationwide, uniform procedures, “Regions are [now] free to implement their own [case management] programs.”
As each Region decides how best to process its cases, employers should expect to see some changes in how cases are prioritized and how deadlines are managed. Should more information come to light, especially from Region 28, we will share it with you.
