EEOC Releases 2019 Data

The EEOC recently released its 2019 Enforcement and Litigation Data that can be helpful to employers looking at the bigger picture.

The EEOC’s data show that 72,675 workplace discrimination charges were filed with the EEOC during fiscal year 2019. This is a decrease in charges from fiscal year 2018, during which 76,418 charges were filed.

The 2019 data also show that 53.8 percent of all charges filed involved some type of retaliation allegation, and the next most frequent discrimination charge allegations were:

  • disability (33.4%),
  • race (33.0%), and
  • sex (32.4%).

A comparison of this data over the years of 1997 through 2019 shows that disability and retaliation charges continue to increase each year, with 2019 marking the highest percentage of retaliation and disability charges ever filed with the EEOC.

The EEOC also provides a breakdown of charges by state. While Nevada charges represented only 1.2% of the total charges filed in the United States, 896 EEOC charges were filed against Nevada employers in 2019. This is an increase from 2018’s 794 charges. Moreover, Nevada saw an increase in nearly every discrimination category tracked by the EEOC.
