NV OSHA Adopts Construction PPE Rule
On February 7, 2025, the Nevada Occupational Safety and Health Administration (NV OSHA) adopted the federal OSHA’s new rule on Personal Protective Equipment in Construction. As we wrote in January, this new rule requires that construction PPE “properly fits.”
NV OSHA points out that the PPE standards for general industry already use this language and that the change is meant to align the construction industry’s PPE standard. All required PPE must be “of safe design and construction for the work to be performed and selected to ensure that it properly fits each affected employee.” NV OSHA further explains that PPE should be of “appropriate size to provide an employee with the necessary protection from hazards and not create additional hazards due to equipment being either too big or small.”
As we previously noted, it was not entirely clear whether the federal OSHA would rescind this new rule after President Trump’s inauguration. NV OSHA’s adoption of the rule essentially ends any such speculation. Nevada construction employers should ensure compliance with the new standard.
