DOL Issues New Opinion Letters

The Department of Labor’s Wage and Hour Division released two new opinion letters on December 21, 2018. The letters address compliance under the Fair Labor Standards Act (FLSA) on the following issues:

  • Determining minimum wage and overtime compliance for employees with varying average hourly rates
  • Application of the ministerial exception to members of an egalitarian religious commune

An opinion letter is an official, written opinion by the Wage and Hour Division on how a particular law applies in specific circumstances presented by the person or entity requesting the letter. Opinion letters are short, concise and generally very instructive on how the Division applies these complicated laws. Opinion letters can also serve as great refreshers and teaching tools.
