Paid Time Off For Vaccines

Last week, President Biden called on every employer to give employees paid time off to obtain and recover from a COVID-19 vaccine. He mentioned that small and midsized employers can obtain a tax credit to reimburse the costs of this paid time off via the American Rescue Plan Act of 2021 (ARPA). The Internal Review Service (IRS) has now published a fact sheet explaining this tax credit program.

Public and private employers with fewer than 500 employees are eligible for the tax credits. The tax credits are available for wages paid for leave from April 1, 2021 through September 30, 2021. The fact sheet further details how the tax credit is calculated and how employers claim the tax credit.

Nevada employers are not currently required to provide paid time off for COVID-19 vaccines. If you choose to provide paid time off for vaccinations, you may be entitled to these tax credits. 

Senate Bill 209, now pending before the Nevada Legislature, seeks to amend Nevada’s paid leave statute to require employers to provide a few hours of paid leave for this purpose; we will keep you posted on its progress.
